2. The petitioner apprehends his arrest in connection with Angarghat P.S. Case No. 56 of 2023, registered for the offences punishable under Sections 147, 148, 149, 447, 436, 379 and 323 of the Indian Penal Code.
3. The allegation against the petitioner is that he set ablaze the house of the informant on account of previous land dispute. It is further alleged that co-accused Raju Ray has assaulted one Matkunia Devi by means of iron rod, due to which she sustained serious injury and other co-accused persons snatched the valuables.
4. Learned counsel appearing on behalf of the

No.64767 of 2023(2) dt.19-10-2023 2/3 petitioner submits that admittedly there is a land dispute between the parties, which resulted into a free fight between the persons of both the sides. There is a counter version of the present case being Angarghat P.S. Case No. 55 of 2023, which is on earlier point of time instituted by co-accused Ram Sagar Ray. He next submits that the co-accused Raju Ray, against whom there is allegation of assault, has been allowed the privilege of anticipatory bail by learned co-ordinate Bench of this Court in Cr. Misc. No. 53277 of 2023 vide order dated 30.08.2023. The petitioner is a man of fair antecedent and he undertakes that he will fully co-operate in the investigation or in the proceeding of the Court.
5. On the other hand, learned counsel for the State opposed the pre-arrest bail application.

Regard being had to the submissions made on behalf of the parties and considering the case and counter case and the fact that the co-accused persons has been allowed the privilege of anticipatory bail by the learned co-ordinate Bench of this Court, coupled with the fair antecedent of the petitioner, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of

No.64767 of 2023(2) dt.19-10-2023 3/3 this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate - 1st Class, Dalsingsarai (Samastipur) in connection with Angarghat P.S. Case No. 56 of 2023, subject to the conditions laid down in Section 438(2) Cr.P.C. with the further condition that one of the bailors shall be the own/close family members of the petitioner.
