This application, for grant of anticipatory bail, arises out of Sikrhta Police Station Case No. 57 of 2018, disclosing offences under Sections 341/323/324/308/504/354/506/34 of the Indian Penal Code.
Learned Counsel for the petitioner is correct in his submission, with reference to the First Information Report, that the criminal case arises out of dispute in the family. The petitioner, who is lady, is said to have assaulted the informant's mother with fists and slaps.
Considering the nature of accusation, this application is allowed.
Patna High Court Cr.Misc. No.76817 of 2018(2) dt.11-01-2019 2/2 Let the petitioner, Prabhawati Devi, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bhojpur, at Ara, in connection with Sikrhta Police Station Case No. 57 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
