JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 20-02-2023 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Bidupur P.S. Case No. 543 of 2021 registered for the offence under Sections 147, 148, 149, 341, 323, 307, 379 and 427 of the Indian Penal Code and Section 27 of the Arms Act along with Section 3⁄4 of Explosive Act.

The accused/petitioner is named in the F.I.R. and is in custody since 27.08.2022.

The allegation against the petitioner is to explode a bomb outside the school along with other co-accused persons

Patna High Court CR. MISC. No.61509 of 2022(2) dt.20-02-2023 2/3 with a view to grab the land of the informant. Learned counsel appearing on behalf of the petitioner submitted that the allegation against this petitioner is very much general and omnibus, admittedly, in the background of previous enmities arises out of land dispute, what appears from the face of FIR. It is also submitted that similarly situated co-accused person has already been granted bail by one of the learned coordinate Bench of this Court through Cr. Misc. No. 55867 of 2022 dated 16.12.2022. While concluding the argument, it is submitted that petitioner also found involved in one case, where, he is on bail and moreover, investigation of this case has been completed, for which, charge-sheet has already been submitted, and as such, there is no chance of tampering with the evidence. Learned APP appearing on behalf of the State, opposes the prayer of bail.

Considering the facts and circumstances as mentioned above, as allegation appears against this petitioner is very much general and omnibus coupled with the fact that charge-sheet has already been submitted, let the petitioner, above named, is directed to be released on bail in connection with Bidupur P.S. Case No. 543 of 2021, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount
