The petitioners are apprehending their arrest in connection with Ariari P.S. Case No. 90 of 2017/ POCSO Case No. 17 of 2017 registered under Sections 363, 366A, 372 of the Indian Penal Code and 8 of POCSO Act.

Allegation against the petitioners is of kidnapping the daughter of the informant and there is other allegation against other accused persons.

Submission of learned counsel for the petitioners is that there is no specific allegation against the petitioners and further victim has now been married with one Dhiraj on 15.4.2017.

Having heard both sides and in view of facts and

Patna High Court Cr.Misc. No.37260 of 2017 (2) dt.19-08-2017 2/2 circumstances, to my opinion, this is not a fit case for grant of anticipatory bail. Let petitioners surrender before the court below and make prayer for regular bail, which shall be considered on the basis of submission made above and the court below will pass an appropriate order, without being prejudiced by this order. With the above observation, this application is disposed of.
