Patna High Court LPA No.1404 of 2015 dt.22-08-2017 2/2 counsel for the State.
Learned counsel for the appellants informs the Court that despite the tender no civil work has been done regarding construction of boundary wall over the plots in question. The reason for the appellants to rush to the Court was the issuance of an e-tender. If the tender has not been acted upon, the imminent threat or the reason for approaching the Writ Court has vanished over a period of time. Learned counsel for the appellants submits that the plots of land, which have been indicated in the e-tender, belong to them and they have filed objection and appeal is also pending before the Collector.
Let them follow it up by moving the Collector for an early adjudication of the matter. The Collector would be well advised to decide the issue instead of keeping the dispute pending and alive. Appeal stands disposed of in terms of the above observations.
