The petitioner apprehends his arrest in a case registered for the offence punishable u/s 147, 148, 149, 341, 353 and 427 of the IPC and u/s 3 of Prevention of Damage to Public Property Act 1984.

Allegedly, the petitioner and others, being on strike, broke the C.C.T.V. camera of the Circle Officer and tried to break down the law and order. They also obstructed the official work and transportation of public.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to grudge. No such occurrence, in the manner as alleged, has ever taken place. The allegation leveled against the petitioner is not specific rather

Patna High Court CR. MISC. No.61287 of 2022(2) dt.10-01-2023 2/2 general and omnibus in nature. Petitioner is one of the member, who were on strike but no property was damaged by them. The said C.C.T.V. camera was not functional and was in broken condition from prior to the said date of strike but due to malafide intention, with a view to harass the strikers, the petitioner and others have been implicated in this case. Petitioner has one criminal antecedent.

Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case, since there is no specific overt act against the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Jogapatti P.S. Case No.309 of 2022 (G.R. No.2690/2022), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
