JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-01-2023 Heard the learned counsel for the petitioner and the learned APP for the State. The petitioner seeks regular bail in connection with Bounsi P.S. Case No.116 of 2022, registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

The accused persons including the petitioner herein, who is the husband of the deceased victim lady are alleged to have firstly physically and mentally tortured the deceased victim lady on account of non-fulfillment of the

The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case, he is having a clean antecedent and he is languishing in custody since 25.05.2022. The learned counsel for the petitioner has submitted that there is no eye witness to the alleged occurrence and the petitioner has been roped in the present case falsely.

Per contra, the learned APP for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials on record as also having perused the impugned order dated 05.09.2022, this Court finds that the complicity of the petitioner in the alleged occurrence is writ large, more so, since he is the husband of the deceased victim lady, hence, I
