====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------ 11-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Forbesganj P.S. Case No.121 of 2017 registered under Sections 324 and 307/34 of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that while the informant alongwith his villagers Upendra Thakur and Rajendra Mandal was sitting in front of his door, all of sudden, he felt that someone has pierced something to him. Thereafter, the informant started to cry. In the meantime, Upendra Thakur and Rajendra Mandal supported him and the informant saw the blood oozing out from his left hand and

Thereafter, on the cry of the informant, Upendra Thakur and Rajendra Mandal, the neighbours of the informant rushed there. The informant raised suspicion against the petitioner, Kalanand Thakur and Vinod Thakur having hand in the alleged occurrence due to dispute of partition of the land.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the informant has only raised suspicion against the petitioner and others due to old grudge and enmity. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No.121 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
