JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 13.8.2014 in a case registered for the offences punishable under Sections 341,323 and 376/34 of the Indian Penal Code.

It is alleged that three accused persons came, two of them started assaulting the brother in law of the informant whereas the third one established forceful physical relationship with the informant. Subsequently, two persons namely Binod Sahni and Sonu Sahni were apprehended from the place of occurrence. It is submitted by the learned counsel for the petitioner that during investigation it transpired that the forceful physical relationship was established by Binod Sahni. Sonu Sahni has been granted bail vide Cr. Misc. No. 45598 of 2013. Statement has been made in paragraph 3 of the petition that the petitioner has no

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur in connection with Kalyanpur P.S. Case No. 192 of 2013.
