2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 341, 323, 324, 307, 379, 504, 506, 325 and 34 of the Indian Penal Code.
3. As per FIR, the allegation against the accused persons including the petitioner are that they assaulted the informant by means of lathi, danda and iron rod due to which he sustained injuries. It is further alleged that they also family members of the informant
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this present case merely on the basis previous enmity. There is no
Patna High Court CR. MISC. No.65593 of 2023(2) dt.13-10-2023 2/2 specific allegation levelled against the petitioner rather general and omnibus allegation levelled against him. As per impugned order, it appears that the injuries sustained by the injured are simple in nature. Similarly situated co-accused persons have already been granted bail by a coordinate Bench of this Court vide order dated 11.03.2022 passed in Cr. Misc No. 18483 of 2021. It is further submitted that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 09.11.2022.
5. Learned APP appearing for the State has vehemently opposed the prayer of Bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bihta P.S. Case No. 518 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II, Danapur.
