The petitioners apprehend their arrest in connection with Sathi P.S.Case No. 09 of 2017 for the offences punishable under Sections 147, 148, 341, 323, 324, 307, 379, 504 and 506 of the Indian penal Code.
The accusation is that four persons named in the F.I.R. including the petitioners having arms reached at the house of the informant, Zebun Nesha and started to abuse. On the protest by the husband of informant, Neshar Ahmad ordered to kill, then petitioner No. 1, Munna @ Mukhtar Ahmad assaulted the husband of the informant by means of iron rod upon which the informant rushed to save then petitioner No. 2, Nesar Alam inflicted farsa
Patna High Court Cr.Misc. No.24191 of 2017 (3) dt.28-08-2017 2/2 blow causing injury in both hands. Amaluddin and Munni Khatoon also assaulted the informant and her husband by means of lathi and they entered into her house and looted the articles. At the time, Nesar Ahmad took away Rs. 20,000/- from the box while Munna Sheikh snatched golden chain.
Learned counsel appearing on behalf of the petitioner submits that in fact due to scuffle in petty dispute, the informant and her husband sustained injuries, which are simple in nature. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- ( Ten thousand) each with two sureties of the like amount each in connection with learned Additional Chief Judicial Magistrate- VII, West Champaran, Bettiah in connection with Sathi P.S.Case No. 09 of 2017 to the satisfaction of learned Additional Chief Judicial Magistrate- VII, West Champaran, Bettiah, subject to the condition laid down under Section 438 (2) of the Criminal Procedure Code.
