====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 18-10-2023 Heard Mr. Braj Kishore Singh Chouhan, learned counsel appearing on behalf of the petitioner and Mr. Sanjay Kumar, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Raghopur P.S. Case No. 225 of 2022 registered for the offence punishable under Section 392 of the Indian Penal Code.

3. The allegation is of committing robbery of Rs.71,465/- along with other valuable articles of the informant.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner has clean antecedent and he is not involved in alleged commission of offence. The name of the petitioner has surfaced in the case on the basis of confessional statement of two other apprehended co-accused who had confessed in police custody that petitioner had also

Patna High Court CR. MISC. No.66394 of 2023(2) dt.18-10-2023 2/2 associated him. Learned counsel submits that such confessional statement made in the police custody has no evidentiary value in the eye of law. Petitioner has clean antecedent.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the nature of allegation made against the petitioner, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Hajipur in connection with Raghopur P.S. Case No. 225 of 2022, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
