JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307,379 and 504/34 of the Indian Penal Code. The prosecution case is that the accused persons tried to grab the land of the informant when protest was made, on the order of petitioner Arjun Thakur, co accused Braj Nandan Thakur caused injury on the head of the informant by farsa. Petitioner nos. 4 and 5 assaulted the informant with lathi. It is further alleged that petitioner nos. 1 and 2 tied towel around the neck of the informant and petitioner no. 4 took away gold chain from the informant. It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.24141 of 2016 (2) dt.31-05-2016 2/2 that the accusation has been levelled in the background of serious land dispute. The injury on the informant has been found to be simple and title suit no. 41 of 2015 is pending between the parties. There is counter version of the occurrence also. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Jhanjharpur, Madhubani, in connection with Laukaha (Lalamaniya) P.S. Case No. 181 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
