The present petition has been filed with a prayer to restore C.W.J.C. No. 17265 of 2010, which stood dismissed on 24-06-2015, due to non-prosecution.

After hearing the parties and considering the ground set-forth in the petition i.e. "since cause list was not marked, he failed to appear", the Court is of the opinion that it is a good ground for allowing the petition.

The restoration petition stands allowed.

Let C.W.J.C. No. 17265 of 2010 be restored to its original file.
