In this case, the petitioner is seeking bail in connection with Muffasil P.S. case no. 129/2016 registered for offence under Sections 414, 420/34.
The police was doing checking of vehicles and by that time, a 100 cc Hero Honda mototcycle reached there but when the rider of the motorcycle saw police party, he started fleeing away. The petitioner along with Rocky Kumar were chased and arrested. The motorcycle is alleged to be stolen one. Learned counsel for the petitioner submits that Rocky Kumar was driving the motorcycle and he had taken lift from Rocky who happens to be his friend. It is further submitted in
Patna High Court Cr.Misc. No.23778 of 2016 (2) dt.31-05-2016 2/2 paragraph 3 that petitioner has no criminal antecedent. It is submitted that petitioner is in custody since 15.03.2016. Looking to the facts and circumstances of the case, let the petitioner, namely, Pradeep Kumar be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Muffasil PS case no. 129/16, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
