JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 This application, for grant of anticipatory bail, arises out of Saharsa Sadar P.S. Case No. 370/18, disclosing offences under Sections 406, 420, 504 and 120(B) of the Indian Penal Code.
Allegation is that the informant has executed a sale deed with respect to certain piece of land for a consideration of Rs. 17,82,000/- in favour of petitioner no. 1 and petitioner no. 2 is the deed writer but the petitioner no. 1 did not pay the aforesaid amount.
Submission of learned counsel for the petitioners that they have falsely been implicated in this case, which will appear from the fact that the present case has been filed after lapse of one year from the date of execution of sale deed and further the
Patna High Court Cr.Misc. No.78205 of 2018(2) dt.07-01-2019 2/2 informant has also not made any effort for cancellation of sale deed.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Six Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Saharsa Sadar P.S. Case No. 370/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is further subject to the condition that they will cooperate in investigation of the case and will appear as and when required by the police, except on showing genuine reasons.
