The petitioner apprehends his arrest in Bhagalpur Kotwali P.S. Case No. 221 of 2013, registered for the offences punishable under Section 419 and other Sections of the Indian Penal Code and under Section 10 of the Examination Act. Allegation is that in place of the petitioner one Mohit Kumar was appearing at the S.S.C. examination meant for the post of L.D.C./U.D.C. of the central government. Four persons were apprehended including Mohit Kumar.
Learned counsel for the petitioner submits that the petitioner is innocent and some interpolation is made in the FIR. Be that as it may, on perusal of the records, it appears that Mohit Kumar impersonating the petitioner appeared at the
Patna High Court Cr.Misc. No.40450 of 2014 (2) dt.25-03-2015 2/2 S.S.C. examination, hence, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
