JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-01-2019 The petitioner apprehends his arrest in connection with Special Case No. 2576 of 2017 arising out of Fatuha P.S.Case No. 217 of 2017 registered under Sections 120B of the Indian penal Code and 30(a) of the Bihar Prohibition and Excise (Amendment) Act.

Allegation as per the FIR is that police on receiving information raided the place and recovered 15.30 litres of wine and 06 persons were arrested there though some were succeeded in fleeing away and arrested accused disclosed the name of this petitioner and other accused persons.

Submission of learned counsel for the petitioner is that nothing has been recovered from the possession of this petitioner and the persons who have also been named by the arrested accused, have been granted anticipatory bail by the co-

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No. 2576 of 2017 arising out of Fatuha P.S.Case No. 217 of 2017; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
