2. Permission is accorded.

3. Heard learned counsel for the parties.

4. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 323, 324, 341, 392, 504, 506/34 of the Indian Penal Code.

5. As per the complaint case, this petitioner along

Patna High Court CR. MISC. No.66090 of 2023(2) dt.17-10-2023 2/3 with co-accused Lakshman disrobed the wife and daughter of the informant and snatched bag and other materials.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to land dispute between the petitioner and his brother Shambhu Prasad and for which F.A. No. 207 of 2010 is pending. It is further submitted that earlier Alamganj P.S. Case No. 1011 of 2022 was lodged by one Jyoti Devi wife of Anil Shah (accused no. 3) when the complainant along with others tried to capture the land of the petitioner. It is lastly submitted that complainant is an advocate and he in the habit of implicating this petitioner in one case after other.

7. Learned APP for the State vehemently opposed the prayer of bail.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna/concerned court below in connection with Complainant Case No. 2845(C)
