The petitioner prays for grant of anticipatory bail in Katihar (Town) P.S. Case No. 370 of 2018 registered for the offence punishable under Sections 376 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

The allegation against the petitioner is of committing rape upon the informant.

The anticipatory bail of the petitioner was rejected on 08.04.2019, thereafter, without any change in circumstances, the present second application for anticipatory bail has been filed. Learned Advocate for the petitioner is not able to point out any new fact so that the Court may interfere in the case.

This is a case of the year 2018 in which the petitioner has not surrendered till date despite his prayer for anticipatory bail having been rejected vide order dated 08.04.2019. The petitioner is directed to surrender in the Court below within a week.

If the petitioner does not surrender within a week, the S.P., Katihar, shall get the petitioner arrested within next week and submit a report about the compliance of the order. Let the order be communicated to the S.P., Katihar through FAX and telephone.
