JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 This is an application for grant of anticipatory bail in connection with Gopalganj Town P.S. Case No. 647 of 2018, disclosing offences under Sections 452, 353, 387, 323, 420, 467, 468, 469, 470, 471, 506 and 120(B) of the Indian Penal Code. Allegation as per F.I.R. is that the co-accused persons, who are Vendor and Vendee, is of try to pressurize the Registrar in order to get the sale-deed registered and it is alleged that the petitioner's hand is also involved in this case. Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and he has made accused only on the basis of confessional statement of co-accused and moreover no specific allegation has been attributed against the petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj Town P.S. Case No. 647 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
