The petitioner apprehends his arrest in Sitamarhi (Punaura O.P.) P.S. case No. 640 of 2018 registered under Section 366A/34 of the Indian Penal Code.
The informant alleged that his daughter was kidnapped by four persons, namely, Rubi Kumari, Basant Kumar, Sanjit Kumar, the petitioner, and Amit Kumar from Bhoraha Chowk by a four wheeler.
The learned counsel for the petitioner submits that statement of victim under Section 164 of the Cr. P.C. has been recorded. The victim denied the factum of her kidnapping. She disclosed that she gone to Maika of her grand mother without informing her parents.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.74996 of 2018(2) dt.21-12-2018 2/2 allegation made against the petitioner and the fact that victim herself denied the factum of her kidnapping, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi (Punaura O.P.) P.S. case No. 640 of 2018 subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
