This application for anticipatory bail arises out of Bakhtiyarpur P.S. Case No. 562 of 2018, disclosing the offence under Sections 304 (B)/34 of the Indian Penal Code. Petitioner is married sister of the husband of the deceased.
Learned counsel appearing on behalf of the petitioner has submitted that there is general allegation against all the persons named in the FIR of making demand of dowry. He has also argued that petitioner has been falsely implicated in this case because cordial relation of the husband of the deceased. There is no other material of implicating her. Considering the above, this application is allowed. Let
Patna High Court CR. MISC. No.57805 of 2019(2) dt.13-09-2019 2/2 the petitioner, above-named, in the event of her arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand), with two sureties of the like amount, each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, Barh, Patna, in connection with Bakhtiyarpur P.S Case No. 562 of 2018, subject to the condition as laid down under Section 438
(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the police/ Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bounds shall be liable to be cancelled.
