JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-05-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 435, 427, 147, 341, 448, 323, 379, 354, 504, 506 of the Indian Penal Code.
The prosecution case is that the accused persons entered into the house of the informant and assaulted the informant and his wife and snatched gold chain worth Rs. 30,000/-. Subsequently on the order of co-accused Pankaj Rai the petitioners put the fodder house of the informant on fire. It is submitted by learned counsel for the petitioners that even assuming the accusation, at best the case under Section 435 I.P.C is made out which is bailable. The rest of the accusation is omnibus and general. The petitioners are agnates of the informant and in the background of land dispute
Patna High Court Cr.Misc. No.23604 of 2016 (2) dt.26-05-2016 2/2 the accusation has been levelled. There is counter version of the occurrence also.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 73 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
