The petitioner seeks anticipatory bail in connection with Industrial Area P.S.Case No. 85 of 2018, registered for offences punishable under Sections 302, 120 (B) and 27 of the Arms Act.

Allegation as per F.I.R. against the petitioner is of causing the death of the deceased.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in the case and the petitioner has not been named in the F.I.R. and he has no criminal antecedent.

At the very outset learned counsel for the informant has informed that process under Section 82 Cr.P.C. has already been issued against the petitioner which appears from case

Patna High Court Cr.Misc. No.985 of 2019(4) dt.20-02-2019 2/2 diary.

Having heard both sides and in view of the facts and circumstances as discussed above, the case of the petitioner is concerned, I am not inclined to grant bail to the petitioner, Accordingly, prayer of anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrender before the court below within a period of four weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on the basis of the materials, available on the record without being prejudiced by this order of this Court.

This application is accordingly disposed of.
