JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.
The prosecution case is of enticing the minor daughter of the informant by co accused Vijay Paswan and other accused persons. Petitioner is the mother of Vijay Paswan. It is submitted by the learned counsel for the petitioner that the victim is major and has performed marriage with Vijay Paswan on her own sweet will. The petitioner is ready to produce the victim before the learned court below on 27th June, 2016. In the circumstances, let the above named petitioner be released on provisional anticipatory bail for two months in the
Patna High Court Cr.Misc. No.23733 of 2016 (2) dt.26-05-2016 2/2 event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Runnisaidpur P.S. Case No.563 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The learned court below will record the statement of the victim girl and if the victim girl admits that she got married with co accused Vijay Paswan of her own then the learned court below will confirm the provisional bail of the petitioner and in case the victim girl states otherwise and alleges something against the petitioner then she will surrender and pray for regular bail.
