JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 This is an application for grant of anticipatory bail in connection with Gogari P.S. Case No. 249 of 2018, disclosing offences under Sections 160, 307 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per F.I.R. is that police received an information that firing is going on between the two groups and one person namely Amarjeet Sah received firearm injury and the petitioners are named in the F.I.R. Further it appears that petitioner no.1 is accused in one other case and petitioner no.2 is accused in two other cases.
Submission of learned counsel for the petitioners is that they are falsely been implicated in this case and no specific allegation has been attributed against any of the petitioners.

Having heard both sides, in view of the facts and circumstances of this case, I am not inclined to grant anticipatory bail to the petitioners. However, if the petitioners surrender before the learned court below and make prayer for regular bail and the court below shall dispose off the same on the basis of materials available on record, if possible on the same day, without being prejudice by order of this Court.
