The petitioner has been non-suited for being considered for grant of license under P.D.S. scheme on compassionate ground solely for the reason that he is not a matriculate.

The learned counsel for the petitioner has submitted that he has passed Madhyama from Bihar Sanskrit Shiksha Board, which is equivalent to matriculation degree of the Bihar School Examination Board.

Under the aforesaid circumstances, we direct the

Patna High Court CWJC No.304 of 2022(2) dt.23-02-2022 2/2 petitioner to make a suitable representation before the District Magistrate, West Champaran at Bettiah / respondent no. 2 in that regard within a period of four weeks when the concerned respondent shall look into the matter and take a decision and thereafter a sequel order shall be passed within a period of 60 days from the date of filling of such representation by the petitioner.
