JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2019 The petitioner apprehends his arrest in connection with Majhaulia P.S.Case No. 308 of 2018 registered under Sections 30(a) of the Bihar Prohibition and Excise Act. Allegation is of recovery of ten and half litres of liquor from the house of petitioner and apart from that, 2 Kg Jaggery and 300 grams Naushadar for preparation of toddy were also recovered.

Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case and he has no criminal antecedent.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within

Patna High Court CR. MISC. No.1515 of 2019(4) dt.28-02-2019 2/2 a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran in connection with Majhaulia P.S. Case No. 308 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
