The petitioner is apprehending his arrest in connection with Mahila P.S.Case No.102 of 2018 registered for offences punishable under Sections 498A/34 of the Indian Penal Code. The case is under Section 498A of the IPC and both the parties have appeared and the matter was referred to the Mediation Committee. It appears from the report of the Mediation Committee that an agreement has been reached between the parties and the petitioner was directed to take her on the condition as mentioned in the agreement, however, it appears that the petitioner has not taken her . It is submitted by the learned counsel for the petitioner that he is still ready to take her.

In such view of the matter, this application is disposed of

Patna High Court CR. MISC. No. 79502 of 2018(3) dt.28-02-2019 2/2 with direction to the petitioner to bring his wife back and keep her with dignity and care and surrender before the learned court below by 11.03.2019 and on that day O.P.no.2 shall also remain present in the learned court below and on their appearance the learned court below shall release the petitioner on provisional bail for the period of six months to watch their conduct by calling both the parties in the learned court below in the first week of each month and once it is found by the learned court below that the petitioner is anyway is not interested in keeping his wife and he is on fault, his bail bond shall be cancelled otherwise on finding that both the parties are living peacefully, his bail bond shall be confirmed.
