Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 307/379 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that so far as petitioner no.1 is concerned there is general and omnibus allegation of assault and no specific overt act has been alleged against him. Petitioner no.2 is alleged to have snatched golden chain and cash of Rs.3000/- from the informant. There is case and counter case in which petitioner no.1 is also alleged to have sustained injuries. Specific allegation of assault is against co-accused Md.

Ehtesham and Md.

Sayed.

Learned counsel appearing for the State as well as the informant oppose the prayer for bail.

Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate IV, Nawada in Kawakol Police Station Case No. 181 of 2021, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
