JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 406 of the Indian Penal Code.

The prosecution case is that the complainant paid Rs.2,51,000/- to the petitioner for transfer of a land but neither the sale deed was executed nor the money was returned. It is submitted by the learned counsel for the petitioner that there is no proof with regard to the payment and due to partnership dispute between the petitioner and the complainant,

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Muzaffarpur in connection with Complaint Case No. 25 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
