The petitioner apprehends his arrest in Rupaspur P.S. Case No. 42/2017, registered for the offences punishable under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code. The informant named accused persons and alleged that Upendra Kumar took him to an office situated in IAS Colony, where they introduced the informant with Sk. Mujammile Hussain, who assured him to give a contract for appointment of teachers under Din Dayal Upadhyay Bal Siksha Jyoti Yojana. On such assurance, the informant paid Sk. Mujammile Hussain Rs. 8,50,000/- trough different modes in his account. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. Name of the petitioner figured

Patna High Court Cr.Misc. No.43491 of 2017 (2) dt.19-09-2017 2/2 in the case during course of investigation only on the ground that a cheque of the petitioner was found in the office of Sk. Mujammile Hussain. The house is taken on rent from one Bablu Singh, s/o late Dhaneshwar Prasad Singh, IAS by the petitoiner. It is submitted that save and except recovery of one cheque-book from that house, there is absolutely no other material. The informant did not make any allegation that the petitioner took any money from him or assured him for any employment.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Danapur in connection with Rupaspur P.S. Case No. 42/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
