2. The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. The petitioner had already been granted bail vide order dated 20.05.2025 passed by this Court on merits (Annexure-P/1). It has, however, been submitted that upon verification four more criminal antecedents were reported and hence, a modification application which was filed on behalf of the petitioner was also rejected vide order dated 11.07.2025 with a liberty to file a fresh petition to be taken into consideration. The present petition has, thus, been filed on behalf of the petitioner stating the correct state of criminal antecedents.

4. Learned APP for the State opposes the prayer for bail.

5. It is taken into consideration that the petitioner had already been granted anticipatory bail upon merits and it is only on account of discrepancy in the criminal antecedent that the bail bonds were not accepted. Considering the fact that this is a fresh application and the petitioner is in custody since 05.04.2025 and further, the charge-sheet has been submitted, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Rail P.S. Case No. 80 of 2025, subject to the conditions:

(I) The petitioner shall co-operate in the investigation/trial.

(II) One of the bailors shall be a family member/close relative of the petitioner.
