Petitioners apprehend their arrest in connection with a case registered under Sections 406, 420 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation in brief is that the complainant fixed the date of marriage the daughter to the son of the informant and also transferred Rs.2,51,000/- in his Bank Account but marriage could not be solemnized as he was demanded further dowry and money was also not returned back.

Submission is that the money was returned back in

Patna High Court Cr.Misc. No.39016 of 2017 (2) dt.21-08-2017 2/2 cash to the complainant before the Punches and the complainant too has signed over it and marriage could not take place due to some other reason and not for realizing further dowry. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, namely, Chandradev Das and Suchit Kumar Das be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Bhagalpur in connection with Complaint Case No.651 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
