Mr. J. N. Thakur, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-10-2017 Heard learned Counsel appearing on behalf of the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341/323/406/504/506 of the Indian Penal Code. The prosecution case as per the written report of the informant, Sachin Gaund, dated 05.04.2017, is to the effect that on assurance of the petitioner for awarding agency of LED Bulb, the informant got issued a demand draft of Rupees Two Lacs in favour of M/S Pack Media Service and Solution, but neither the agency was provided to him nor the money was returned back.

It is submitted by learned Counsel appearing on behalf of the petitioner that the petitioner is not connected with

Even the photocopy of the bank draft has also not been brought on record to suggest that any draft was actually prepared, though the petitioner is also an accused in one other case. Even assuming the accusation no offence under section 406 of the I.P.C. is made out.

Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul, in connection with Chatapur P.S. Case No.100/2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
