JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-05-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 324, 307, 325, 354, 436, 504, 506 of the Indian Penal Code.
The prosecution case is that the accused persons came variously armed when co-accused Laltu Yadav assaulted Renu Devi, sister-in-law of the informant with iron rod, causing head injury, thereafter the younger sister-in-law of the informant Pramila Devi came to rescue then co-accused Dharmkant Yadav assaulted her with iron rod causing injury on her head. Thereafter all the accused persons assaulted Surendra Sah and Ranjit Kumar by means of lathi, danda and legs and fists. It is alleged that accused persons put the
Patna High Court Cr.Misc. No.23975 of 2016 (2) dt.30-05-2016 2/2 harvested wheat crop of the informant on fire. It is submitted by learned counsel for the petitioners that specific accusation of assault is only against Laltu Yadav and Dharamkant Yadav. The accusation of assault to Surendra Sah and Ranjit Kumar is omnibus and general against petitioners and others. The opinion with regard to one injury of Ranjit Kumar of parietal region has been kept reserved. The injuries of sisters-in-law of the informant have been found to be simple. Moreover similarly situated coaccused Dip Narayan Yadav and Bhusan Yadav have been granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 26961 of 2015.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S. Case No. 52 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
