This application, for grant of anticipatory bail, arises out of Tarari P.S. Case No. 33/2017, disclosing offences under Sections 323, 341, 307 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act.
There is allegation of opening fire against coaccused Harendra Paswan causing injury to the informant's son. Learned counsel for the petitioners has submitted that there is no injury report on record, which falsifies the case of the prosecution.
Be that as it may, this application is allowed. Let the
Patna High Court Cr.Misc. No.48898 of 2017 (2) dt.17-11-2017 2/2 petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX, Bhojpur at Ara in connection with Tarari P.S. Case No. 33/2017, subject to the condition laid down under Section 438(2) of the Cr.P.C. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
