The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 341, 504 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. It is alleged that the informant's son and other family members were deputed by Durga-asthan Samiti for supervision of the fair which was protested by the accused persons and consequently the accused persons assaulted Arvind, Jogendra and Rohit and abused the informant by calling caste name.

It is submitted by learned counsel for the petitioner that the petitioner is 70 years old and a retired govt.

Patna High Court Cr.Misc. No.33117 of 2015 (2) dt.11-08-2015 2/2 servant. The accusation of assault is against other three persons whereas there is a counter version of the occurrence also and petitioner sides have received injury.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the accusation of assault and abusing by calling caste name is not specific against the petitioner, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Jamui in connection with Laxmipur P.S. Case No. 171 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
