JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-10-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Hajipur Town P.S. Case no. 473 of 2017, registered under Sections 147, 149, 341, 323, 307, 427, 353, 186 and 504 of the Indian Penal Code.

The accusation is that in course of patrolling duty, the informant and other Police officials received information about blockage of N.H. 19 near new Golak bridge, Narayani Mohalla by turning the tyre and fixing wooden log on the road. Thereafter, informant along with other Police officials reached there and saw road was blocked by burning tyre and they were raising slogans against the administration using filthy language anyhow the blockage was cleared and 18 persons, including the petitioners, were identified.

No.47031 of 2017 (2) dt.03-10-2017 2/2 Learned counsel for the petitioners submits that it would appear from the F.I.R. that while petitioners and 16 others were identified as a member of the mob, but no specific overt act has been attributed against the petitioners. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 473 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
