The petitioner seeks bail in a case registered under Sections 341, 307, 504, 34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that while the informant was going to his house, in the way, the accused persons intercepted him and made blank firing. It is also alleged that one firing hit the leg of the informant.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 01-07-2019. Charge sheet has already been submitted. There is no allegation of assault alleged

Patna High Court CR. MISC. No.57949 of 2019(2) dt.13-09-2019 2/2 against the petitioner. No injury is said to have been caused by the petitioner. The petitioner is said to be present there at the time of occurrence. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 932 of 2017.
