The present Writ Petition has been filed for the following reliefs:- "......for a direction to the Collector-cum-District Magistrate, Gaya to dispose of Supply Appeal No. 4 of 2023 (Prashuram Yadav @ Parshuram Yadav Versus The State of Bihar) filed on 20.03.2023 against the order dated 03.06.2022 passed by the Sub-Divisional Officer, Sherghati by which petitioner's PDS license No. 27/2016 was cancelled, which is pending before the Learned Collector-cum-District Magistrate, Gaya."

3. Learned counsel appearing on behalf of the petitioner submits that the petitioner was appointed as PDS dealer in the year, 2016 and the shop has been functioning without any complaint. That the Sub-Divisional Officer vide order dated 03.06.2022 has cancelled the license of the petitioner solely on the ground that a criminal case has been booked against the petitioner and he was sent to jail. Further, learned counsel submits that against the order passed by the Sub-Divisional Officer, the petitioner has preferred a statutory appeal before the Collector-cum-District Magistrate, Gaya but till date the Supply Appeal No. 04 of 2023 has not been disposed of. Learned counsel, therefore, prays this Hon'ble Court to dispose of the present writ petition directing the Collector-cum-District Magistrate, Gaya (Respondent No. 2) to pass necessary orders in the appeal filed by the petitioner.

4. Learned counsel for the Respondent-State submits that he has no objection, if a direction is given to the Collectorcum-District Magistrate, Gaya to pass necessary orders in the appeal filed by the petitioner strictly in accordance with law.

5. Having regard to the above, the present writ petition is disposed of directing the Collector-cum-District Magistrate, Gaya (Respondent No. 2) to dispose of the Supply

Patna High Court CWJC No.14916 of 2025(2) dt.08-10-2025 3/3 Appeal No. 04 of 2023 filed by the petitioner as expeditiously as possible preferably within a period of twelve weeks from the date of receipt of the copy of this order. It is needless to mention that before passing any order the petitioner shall be given an opportunity of hearing.

Any order passed shall be communicated to the party.

6. With the above directions, the present Writ Petition stands disposed of.
