JUSTICE SANJAY KUMAR ORAL ORDER 01-11-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends arrest in connection with N.T.P.C. (Khaira) Police Station Case No. 34 of 2017 registered for the offences under sections 20 and 22 of the Narcotic Drugs and Psychotropic Substance Act.

The case has been registered on the self statement of S.H.O. of N.T.P.C. (Khaira) Police Station, District-Aurangabad and it has been alleged that on secret information, the informant apprehended one Vishundeo Singh who was carrying 9 Kg. Ganja and another occupant of motor cycle is son of apprehended accused and he however was arrested after few hour. The learned counsel for the petitioner submits that this petitioner is son of Vishundeo Singh. He is neither named in the

Patna High Court Cr.Misc. No.50374 of 2017 (2) dt.01-11-2017 2/2 FIR nor there is any allegation. He is being indicted only for the reason that the motor cycle in question stands registered in his name. The apprehended accuseds are not the stranger rather they are family members related as father and brother of this petitioner and so the petitioner having clean antecedent deserves anticipatory bail.

The learned Additional Public Prosecutor on the other hand, opposed the submission.

Considering the facts and circumstances of the case, the prayer of anticipatory bail is allowed and the petitioner, Jai Ram Kumar @ Jai Ram Singh, in the event of arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Narcotic Drugs and Psychotropic Substance Act in connection with N.T.P.C. (Khaira) Police Station Case No. 34 of 2017, subject to the condition as laid down under Section 438 (2) of the Criminal Procedure Code. (Sanjay Kumar, J) Mahesh/- U T
