The petitioner is apprehending his arrest in connection with Phulwaria P.S.Case No.155 of 2018 ated 12.11.2018 , registered for offences punishable under Sections 120(B), 414 of the Indian Penal Code and Section 7 of the E.C. Act. Allegation as per FIR is that the informant seized four bags of rice and four bags of what from the co-accused, who has disclosed the name of the petitioner, who is a P.D.S. Dealer. Submission of the learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner and he has no criminal antecedent as well as he has been named on the basis of confession of the co-accused. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.498 of 2019(2) dt.09-01-2019 2/2 circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Begusarai in connection with Phulwaria P.S.Case no.155 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case. With the aforesaid observation, this application is allowed.
