1. Heard the learned counsel for the petitioner and learned counsel for the State.

2. The petitioner seeks bail in connection with Ladaniya P.S. Case No. 264 of 2022 registered for the offence under Sections 332, 353, 302, 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.

3. As per the prosecution case, After an accident was caused by a motorcycle one Scorpio hit the deceased. From the manner of occurrence it appears that this is a case of accident and not a case of homicide.

4. Learned counsel for the petitioner submits that petitioner is in custody since 07.08.2023 and similarly situated

Patna High Court CR. MISC. No.66841 of 2023(2) dt.16-10-2023 2/2 co-accused Rakesh Yadav has been granted bail by a coordinate bench of this Court vide order dated 28.03.2023 passed in Cr. Misc. No. 66630 of 2022.

5. Considering the period of custody, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd cum Special Judge, Excise Act, Madhubani in connection with Ladaniya P.S. Case No. 264 of 2022.

7. The petitioner will visit Ladaniya Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
