The petitioners apprehend their arrest in connection with Vijaipur P. S. Case No. 66 of 2017 registered for the offences punishable under Sections 341, 323, 504, 307/34 of the Indian Penal Code.
In the first information report it is alleged that Ramchandra assaulted the informant with lathi on her head causing bleeding and the petitioner no. 1 assaulted Brajesh the son of the informant with spear on his hand and Sudarshan Yadav, the husband of the informant, was also assaulted. Submission is of false implication and that there is no injury report of Brajesh and moreover, as per the FIR, Brajesh has not received injury on the vital part of the body. There is
Patna High Court Cr.Misc. No.56986 of 2017(3) dt.16-01-2018 2/2 case and counter case and as such the petitioners deserve sympathetic consideration.
Learned APP submits that co-accused Ramchandra Yadav and Mannu Yadav have been allowed pre-arrest bail vide Cr. Misc. No. 38236 of 2017 vide annexure-3.
In the facts and circumstances stated above, the petitioners above named, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Gopalganj in connection with Vijaipur P. S. Case No. 66 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
