JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Heard learned counsels for the petitioner and the State. Petitioner being the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. The accusation is killing of the daughter of the informant after four months of the marriage for none fulfillment of demand of dowry.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated. The petitioner is the resident of Katihar whereas the place of occurrence is Budhuchak and the distance between both the place is eighty kilometers hence it is impossible that the petitioner would travel such a distance within an hour.
