In spite of indulgence granted to the State respondent no counter affidavit has been filed.
The petitioner seeks a direction upon the respondents to pay him salary of Chaukidar for the period 01.07.1999 to 20.02.2000.
According to his own showing, the petitioner superannuated from service on attaining the age of 58 years on 30.06.1999. It is alleged that the authority took work from the petitioner till 20.02.2000 and thereafter he was allowed to retire. In such circumstance, a prayer has been made to pay his salary for the work done from 01.07.1999 to 20.02.2000.
Patna High Court CWJC No.14933 of 2007 (4) dt.04-05-2015 2 / 2 A.C. S.C. 28 on the basis of instructions received by him states that the petitioner has been paid in excess of his legal dues.
Be that as it may, in my view, considering the pleadings on record the ends of justice shall be subserved if the petitioner is granted liberty to make a representation in this regard before the District Magistrate, Aurangabad (respondent no.2) as well as the Superintendent of Police, Aurangabad (respondent no.
4) who shall, in consultation with each other, take appropriate decision thereon expeditiously in accordance with law. (Kishore Kumar Mandal, J) HR/- U
