JUSTICE SANJAY PRIYA ORAL ORDER 04-01-2018 Heard learned counsel for the petitioners and the State. The petitioners apprehend arrest in Complaint Case No. 189 of 2016 instituted for the offence under Section-3 of D.P. Act. It is alleged in the written report that marriage negotiation of daughter of the complainant was made with Vijay Shankar Sharma (petitioner No. 3) son of petitioner No. 1. It is also alleged that engagement ceremony was performed on 05-07-2015 in Kaimur Hotel where both the bride and bridegroom exchanged the golden ring with each other and the wife of complainant gifted golden chain to petitioner No. 3. The petitioners refused to fix date of marriage and made demand of dowry.
The complainant has alleged that in course of engagement, he incurred the expenses of Rs. 1,56,000/- in the ring ceremony. The learned Magistrate has after holding inquiry found
Patna High Court Cr.Misc. No.49869 of 2017 (3) dt.04-01-2018 prima facie case against the petitioners u/S 3 of D.P. Act. Considering the facts and circumstances, prayer for anticipatory bail is allowed and it is ordered that the petitioners named above in the event of their arrest or surrender in the court below within six weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with in Complaint Case No. 189 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Rohtas, Sasaram subject to condition as laid down u/S 438(2) of the Cr.P.C.
with further conditions (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable reason will be liable to cancel their bail bond and (3) if petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
