JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-03-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 379/411 of the Indian Penal Code, BMMC Rule 2021, 11/18 and 56(i)(ii) and under section 15 of the Environment Protection Act, 1986. A loaded tractor with illegally excavated sand was seized. Petitioner is owner of the said tractor. Learned counsel for the petitioner submits that the petitioner has already deposited fine of Rs.30,400/- in the office of the District Mining Officer, Rohtas at Sasaram vide receipt dated 25.8.2022 contained in Annexure 2 to the bail petition. Considering the submission of the petitioner, prayer for bail of the petitioner is allowed.
